A Win For Small Businesses

In case you didn't know, the U.S. Department of Labor had a new overtime rule that was set to go into effect December 1st. The overtime rule would double the overtime salary limit from $23,660 to $47,476 - creating a significant burden on small home building firms and other businesses. Many small business owners would be forced to scale back on pay and benefits, as well as cut workers’ hours, hurting the very people the rule was intended to help in the first place.


Fortunately a federal judge in Texas granted a preliminary injunction to delay implementation of the Department of Labor’s new overtime rule. The injunction, which was granted on November 22, signals a major win for small businesses. In his opinion, the judge wrote: "the Final Rule exceeds the Department’s authority.”

While the injunction is temporary, this is considered a major win for small businesses and a signal that the rule could be invalidated at some point in the future.
